Permanent Residency (Employment Based)

Permanent Residency (Family Based)

Immigration through family is one of the most common ways of becoming a permanent resident. Who can sponsor a family member?
  • US citizens petitioning for their spouse and children of any age
  • US citizens over 21 years-old petitioning for their brothers and sisters
  • US citizens over 21 years-old petitioning for their parents
  • Green Card holders to petition for their spouse and unmarried children of any age
  • Recent widows or widowers of U.S. citizens
  • Stepchildren of U.S. citizens, if the marriage creating the parent-child relationship took place before the child's 18th birthday
  • Stepparents of U.S. citizens, if the marriage creating the parent-child relationship took place before the US citizen's 18th birthday

Permanent Residency (Marriage)

A U.S. citizen may sponsor his/her spouse for permanent residency. The most common situations for marriage-based immigration are:
  • Both husband and wife are in the U.S.; or
  • Both husband and wife are outside the U.S.; or
  • US Citizen is in the US and alien spouse is outside the U.S. ; or
  • Not yet married, but will marry in the US very soon (fiance / fiancee).
